Evidence mix-up
State prosecutors have said little since it was revealed in September that the latest DNA test failed to bolster the state's case against the two men. An apparent wrong doing or mix-up at the state crime lab linked a strand of hair to McAvoy, according to defense attorney William Koch.
On Wednesday, Koch said he expects to find out more today about the state's stance on the case.
